What you need to know need to Know About Typlex Pipes

If you're a seller or landlord in Western Australia, it's crucial to be aware of the issues surrounding Iplex Pro-fit Typlex 1050 polybutylene plumbing pipes. These pipes, installed in approximately 12,000 to 15,000 homes built or renovated between mid-2017 and mid-2022 and a small number of commercial proprties too. The pipes have been associated with a high rate of plumbing failures, leading to significant property damage and may also impact insurance premiums. 

Realmark recently met with the Real Estate Institute of Western Australia (REIWA),  the peak industry body, to ensure we were accross the key information for our buyers, sellers and landlors of commercial and residential property. 

Remediation Programs

The Western Australian Government, in collaboration with Iplex Australia and participating builders, has established an Industry Response program to address the issues caused by these pipes. The remediation process is tiered based on the number of leaks experienced:

  • One leak: Repair of the affected area and replacement of ceiling pipes.

  • Two leaks: Zone re-piping of the affected area.

  • Three or more leaks: Option for full or partial replacement of all pipes in the home.

These services are provided at no cost to homeowners.

Legislation has extended the period for lodging complaints related to Typlex 1050 pipes from six to 15 years after the home's completion. This extension allows more homeowners to seek remediation through the Building Commissioner if their builder is not participating in the Industry Response.

All homes with Typlex 1050 pipes are eligible for the installation of a free leak detection unit. These devices can automatically shut off water supply in the event of a leak, minimising potential damage. Homeowners can register for installation through the official Industry Response website.


Disclosure Obligations

Typlex 1050 pipes are considered a material fact in property transactions. This means sellers and landlords are legally required to disclose their presence to real estate agents, property managers, and prospective buyers or tenants. Failure to do so can result in legal consequences.  REIWA have recommended agents are proactive with their clients and ensure that they use the new disclosure forms in transactions and ask their landlords if their propery is or could be affected so that this can be documented in property condition reports. 

Our clients have been advised to consult their builder or review building permits and plans available from the local council, and if concerned arrange a professional inspection. Those that own residentail homes can take take advantage of the remediation program.  Commrecial property owners that have the pipies installed may need to install a leak detection system.
